These Terms and Conditions (“Terms”) are a contract between you and Social Sport Pty Ltd (“Social Sport” or “we”) and govern your participation in any Social Sport Leagues, programs or competitions (“Leagues”) at the facilities, grounds, courts, fields (“Venues”) we operate. Please read these Terms carefully before participating in any Social Sport Leagues.
1. TERMS
a) Acceptance of Terms. By participating in any Social Sport Leagues, you accept and agree to be bound by these Terms, just as if you had agreed to these Terms in writing. If you do not agree to these Terms, you must not participate in any Social Sport Leagues.
b) Amendment of Terms. Social Sport may amend the Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon Social Sport posting the updated Terms. Your continued participation in any Social Sport Leagues after the posting of the amended Terms constitutes your consent to be bound by the Terms as amended.
2. OUR SERVICE
Social Sport is a service that organises social sports Leagues at Venues across Melbourne. Social Sport itself does not own, operate or control any Venues that Leagues are operated from.
3. VENUE WAIVERS AND TERMS
Participants of Social Sport are deemed as members. Your participation in any Leagues may be subject to additional waivers, policies, rules or conditions of the Venue where Social Sport Leagues are conducted. Social Sport or the applicable Venue may restrict your access if you do not agree to or comply with such conditions or these Terms. If you have questions about a Venue’s waiver or other terms, please see the applicable Venue’s website or contact the Venue directly.
4. ASSUMPTION OF RISK
Although Social Sport endeavors to offer Venues and Leagues that are safe, you understand that there are certain inherent risks and dangers in participation in sport and that the games you may play in will vary in intensity, skill level & weather conditions. By playing in a Social Sport Leagues, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns that you are aware of these risks which include, but are not limited to, property damage, illness and bodily injury or death. You acknowledge that some of these risks cannot be eliminated and you specifically assume the risk of injury or harm. You acknowledge and agree that it is your responsibility to consult with your primary care physician prior to participating and to determine if and how participating in any Social Sport Leagues.
Therefore, to the fullest extent permitted by law, you release, indemnify, and hold harmless Social Sport, and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities (including for ordinary negligence and the application of any of the provisions of Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) arising out of or in any way related to your participation in Social Sport Leagues, including with respect to bodily injury, physical harm, illness, death or property damage.
5. MEDICAL EXPENSES REIMBURSEMENT
Social Sport is able to provide a level of reimbursement of Non-Medicare medical expenses for injuries sustained while participating in Leagues.
It is important to note that the cover available is not ‘comprehensive’ and we encourage you to take out your own Private Health, Life & Income Protection insurance in accordance with your own needs and circumstances.

6. PAYMENTS
All competition fees are to be paid in full, prior to the release of fixtures for the season in which a team is registered.
CREDITS & REFUNDS
FORFEITS
In the case of a forfeit, Social Sport will always endeavour to find a replacement opponent for the scheduled game time.
Team forfeited against: In the case where a replacement opponent cannot be arranged, the team will receive a one game credit.
Team forfeiting: The team will lose one game credit
BYES & CANCELLATIONS
In the case of a bye or cancellation that has been paid for, teams will receive a game credit.
USE OF CREDITS
Game credit tally is calculated after the completion of the final round of the regular season.
Available credits can be used for a finals game or applied to any future season.
In the case where credits are not used, a refund for the value of the credits can be provided on request.
7. DISCIPLINE
As a condition of participation in Social Sport Leagues, you agree to the Code of Conduct that is outlined in the Social Sport Help Centre, in the ‘Rules’ section of the sport you are participating in.
Social Sport has the right to take any action deemed necessary in the best interests of all participants and all decisions relating to discipline are final.
8. PHOTOGRAPHY
As a condition of participation, Social Sport may use images of your participation at any time to promote our events/competitions or any similar events by any form of media.
9. PRIVACY
Your privacy is important to Social Sport. Social Sport uses high ethical standards and respects your privacy. We will diligently safeguard and protect the privacy and confidentiality of your personal details.
10. COMPLAINTS
All complaints should be issued to [email protected], where management will review each and address accordingly.
