Social Sport - Terms and Conditions

These Terms and Conditions (“Terms”) are a contract between you and Social Sport Pty Ltd (“Social Sport” or “we”) and govern your participation in any Social Sport Leagues, programs, sessions, games or competitions (“Leagues”) at the facilities, grounds, courts, or fields (“Venues”) we operate. Please read these Terms carefully before participating in any Social Sport Leagues.

a) Acceptance of Terms. By participating in any Social Sport Leagues, you accept and agree to be bound by these Terms, just as if you had agreed to these Terms in writing. If you do not agree to these Terms, you must not participate in any Social Sport Leagues.

b) Amendment of Terms. Social Sport may amend the Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon Social Sport's posting the updated Terms. Your continued participation in any Social Sport Leagues after the posting of the amended Terms constitutes your consent to be bound by the Terms as amended.

Social Sport is a service that organises social sports Leagues at Venues across Melbourne. Social Sport itself does not own, operate or control any Venues that Leagues are operated.

Participants of Social Sport are deemed members. Your participation in any Leagues may be subject to additional waivers, policies, rules or conditions of the Venue where Social Sport Leagues are conducted. Social Sport or the applicable Venue may restrict your access if you do not agree to or comply with such conditions or these Terms. If you have questions about a Venue’s waiver or other terms, please see the applicable Venue’s website or contact the Venue directly.

Although Social Sport endeavours to offer Venues and Leagues that are safe, you understand that there are certain inherent risks and dangers in participation in sport and that the games you may play in will vary in intensity, skill level & weather conditions. By playing in a Social Sport League, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns that you are aware of these risks, which include, but are not limited to, property damage, illness, bodily injury or death. You acknowledge that some of these risks cannot be eliminated, and you specifically assume the risk of injury or harm. You acknowledge and agree that it is your responsibility to consult with your primary care physician prior to participating and to determine if and how to participate in any Social Sport Leagues.

Therefore, to the fullest extent permitted by law, you release, indemnify, and hold harmless Social Sport, and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities (including for ordinary negligence and the application of any of the provisions of Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) arising out of or in any way related to your participation in Social Sport Leagues, including with respect to bodily injury, physical harm, illness, death or property damage.

For participants under 18, this release and indemnity is given by that participant's parent or legal guardian on the minor's behalf, in consideration of Social Sport permitting the minor to participate.

Social Sport is able to provide a level of reimbursement for non-Medicare medical expenses for injuries sustained while participating in Leagues.

It is important to note that the cover available is not ‘comprehensive’ and we encourage you to take out your own Private Health, Life & Income Protection insurance in accordance with your own needs and circumstances.

Teams have the flexibility to select whether they pay their competition fees upfront in full or on a weekly basis before each game.

For junior participants, the parent or legal guardian who registers the participant is responsible for all fees, bonds and forfeit charges arising from that participant's involvement in our Leagues.

​6.1 UPFRONT PAYMENTS

Upfront fees are to be paid in full before Round 2, upon the release of fixtures for the season.

The upfront payment will cover all scheduled games (including finals), along with the team’s registration fee for that particular season.

CREDITS & REFUNDS

​FORFEITS

In the case of a forfeit, Social Sport will always endeavour to find a replacement opponent for the scheduled game time.

Team forfeited against: In the case where a replacement opponent cannot be arranged, the team will receive a one-game credit.

Team forfeiting: The team will lose one game credit

BYES & CANCELLATIONS

In the case of a bye or cancellation that has been paid for, teams will receive a game credit.

USE OF CREDITS

The total number of games played across the season will be tallied following the completion of finals night.

In the case where a game credit has been accumulated, this can be applied to any future season.

In the case where credits are not used, a refund for the value of the credits can be provided on request.

Outside of the cases defined above, all competition fees paid to Social Sport are non-refundable.

​6.2 WEEKLY PAYMENTS

Payment of a $200 Refundable Team Bond is required prior to the start of the season to enable the weekly payment option.

This Bond will be returned (or carried over to the following season) when the season has been completed, and the team has paid all required registration fees, match fees and forfeit fees.

If a team withdraws or is removed for disciplinary reasons prior to the end of the season, the Team Bond will not be returned.
​
The Team Bond cannot be used to cover any unpaid fees during the season.

If a team has not paid their weekly fee (or any other outstanding fees) prior to the start of their match, they will not be allowed to take to the court.

As a condition of participation in Social Sport Leagues, you agree to the Code of Conduct that is outlined in the Social Sport Help Centre, in the ‘Rules’ section of the sport you are participating in.

Social Sport has the right to take any action deemed necessary in the best interests of all participants, and all decisions relating to discipline are final.
​

As a condition of participation, Social Sport may use images of your participation at any time to promote our events/competitions or any similar events by any form of media.

For participants under 18, Social Sport will only use identifiable images or video with parent/guardian consent given at registration. Consent can be withdrawn anytime by emailing [email protected], and identified material will be removed within a reasonable time.

Your privacy is important to Social Sport. Social Sport uses high ethical standards and respects your privacy. We will diligently safeguard and protect the privacy and confidentiality of your personal details.

Social Sport is committed to the safety and well-being of all children and young people who participate in our Leagues. We have zero tolerance for child abuse and take all reasonable steps to identify and reduce risks to children in our programs, consistent with Victoria's Child Safe Standards under the Child Wellbeing and Safety Act 2005.

• All Social Sport staff, officials and Venue Managers who work directly with junior participants hold a valid Working with Children Check (WWCC), and Social Sport verifies this before they commence any role involving contact with minors.

• Staff and volunteers working with junior competitions are required to follow Social Sport's Child Safety Code of Conduct.

• Any concern about the safety or well-being of a child participating in a Social Sport League can be reported to [email protected]. Concerns will be treated seriously and confidentially.

All complaints should be submitted to [email protected], where management will review each and address it accordingly.
